I hold a British passport and my wife has a non-EU passport. She holds a Biometric Residence Permit, Indefinite Leave to Remain (ILR), but it was obtained through settlement via Tier 2. Her residence permit is not via spouse of UK citizen.

We are planning to visit Portugal and Germany. We plan to travel together. Can she apply for Schengen visa as a spouse of EU citizen, or would it be better to apply for tourist visa ?

Does the spouse of a EU national with UK permanent residence need a Schengen visa?

If you are the husband or wife of an EU citizen, and you possess an EU residency ID card (i.e. you have residency in one of the 27 states of the EU, either in the same country as your spouse, or from a different EU country), then you do not need a Schengen visa in order to visit the Schengen area.

Can I travel to Schengen countries with UK ILR?

ILR does not entitle a person to travel to the Schengen states visa free. ILR is however a requirement for British citizens to travel there visa free, i.e. a person is only regarded as being "fully" British when he has ILR in the UK. Other types of British citizens may or may not require a visa.

Can UK BRP holder travel to Europe?

You will need your UK biometric residence permit showing that you have valid leave for the UK that extends beyond your trip, and a blank page in your current passport. You can not apply using a travel document unless you have indefinite leave to remain (ILR) in the UK. You must not already have a Schengen visa.

Can I travel to Spain with UK ILR?

UK travellers will still be able to visit Spain and the Schengen Area for up to 3 months as before but will need to hold a valid ETIAS visa waiver before arriving.
