Traveling after expired student visa and expired NIE residency card

Traveling after expired student visa and expired NIE residency card - Happy young couple doing purchase on Internet together at home

My daughter is in Barcelona Spain finishing her Master’s but her student visa expired in November 2021 and her residency card expired March 4 2022.

She is due to return to US end of April 2022. We are going to visit her in early April and planned to go from Barcelona to Italy with her for a few days.

Is she permitted to leave Spain, enter Italy and return to Spain just using her US passport or will she be prevented from traveling out and returning to Spain for the remainder of her stay because the visa and NIE expired?

Can you travel with expired NIE?

The short answer is that you can leave Spain while your NIE renewal is being processed, but you need a permit to return, which in Spanish is called the Autorizacion de Regreso.

Can I travel within Spain with expired NIE?

Under the Spanish legal system, entering Spain with an expired passport or ID card is not an offence. With regard to leaving, you must cross an external border (to a third country) at an authorised border post with a valid passport or travel document.

Can I stay in Spain after my student visa expires?

Can I stay in Spain after my student visa expires? It depends. If you're from a country that doesn't require a visa to come to Spain as a tourist, you can stay for up to 90 days in Spain (or the whole Schengen area) after your visa or your TIE (Foreigner Identity Card) expires.

What happens if NIE expires?

Therefore, if there is anything that expires or is lost, it is the TIE, not the NIE. The NIE number will always be the same throughout your stay as a foreigner in the country. The only thing you will be able to do then is to \u201creactivate\u201d it in case of expiration. The same happens if we lose our TIE or it gets stolen.
