My boyfriend overstayed his visa in the US without realizing (long story) and he was traveling on his British passport via ESTA. His ESTA was revoked as a result. He has now applied for a visa on his South African passport. Will he be able to enter the country if his visa is approved?

Once your friend has overstayed a VWP visit once he is forever barred from entering under the VWP again, no matter which passport he is using.

The only way to be readmitted in this situation is indeed to apply for a visa in advance. It probably doesn't matter much which of the two passports he applies for the visa with; but he will need to be honest about the overstay in his application in either case.

For the best chances of success, he should be sure to append a convincing explanation of the earlier overstay to his application. Do not wait to be asked!


(Applying with the South African passport while pretending that the overstay didn't happen would probably be a quick recipe for being refused for deception, which would make it somewhere between extremely hard and impossible to get any U.S. visa afterwards).

What happens if your ESTA is revoked?

If someone's ESTA is revoked, but he/she does not receive a notification of the revocation, what happens? If a traveler has a revoked ESTA, and he/she is outside the United States, he/she will not be allowed to board a conveyance to the United States.

Can I have an ESTA on 2 passports?

No. Each Visa Waiver Program traveler must have an approved travel authorization for the passport they plan to use before they travel to the United States. If a traveler obtains a new passport, they must submit a new travel authorization application in ESTA using the new passport.

Can you be denied entry with ESTA?

If you already have an approved ESTA, you may still be denied entry to the United States without a visa refusal. On the one hand, the ESTA or any other visa does not guarantee that you can enter the USA. The customs and border guards alone decide whether you are allowed to enter or not.

Is ESTA linked to passport?

An ESTA approval is always linked to a passport and the corresponding passport number. Since your new passport will receive a different passport number, you will need to submit a new ESTA application.
